Mitchell Memorial Youth Arts Centre Ltd (Mitchell Arts Centre) is a charity and a company limited by guarantee registered in England (company number 06418190) and registered with the Charity Commission (registration number 1138139). Please read our privacy policy, as well as our terms and conditions for sales carefully, as they describe what personal information we collect and obtain and how we use it. The terms & conditions for any purchases you make from us are also outlined below. Mitchell Arts Centre is committed to protecting your privacy, and takes its responsibilities regarding the security of customer information very seriously. Everything we do with your personal information is in keeping with the Data Protection Act 1998.

 

1.PRIVACY POLICY

This policy deals with personally identifiable information that may be collected on our website, when you contact us in person or by telephone.

 

1.1. Personal information - information we request directly from you
We collect various personal details when you create your online account and/or make a purchase either online, by phone or by visiting our Box Office. This information would include your name, phone numbers, address, email address etc. We may also keep a record of your transactions with Mitchell Arts Centre and any correspondence between us. You may be asked for further information if we run surveys, competitions, prize draws and other promotional activities. If this is the case, then this privacy policy will apply to the personal information you provide, but please check for any specific terms that apply each time you participate in these activities.
 

1.2. Personal information - information which we obtain
We may also add information to your details, which we have obtained from other companies or sources. For example, we may cross check the accuracy of the information we hold with our Partners, or we may add demographic information available from public sources.

 

1.3. Personal information – how will we use your information

As a ticket agent, Mitchell Arts Centre sometimes sells tickets on behalf the providers of the events for which you buy tickets. This might be an artist, venue, promoter, amateur theatre groups or other arts organisation, producer or sponsor. We refer to the organisers or providers of an event as our "Partners". When you purchase tickets for an event, we share your personal information with our Partner, but only if you have bought tickets for the events that they are providing. There may be more than one Partner for each event. If you have indicated that you do not wish to receive any offers or newsletters, nor should your information be used for marketing purposes, Mitchell Arts Centre will inform the Partner of this condition. After the data has been provided, it is the responsibility of the Partner to comply with the conditions set for the use of the information.

 

1.4. Personal information – providing, improving and customising our services
We use your information primarily to provide you with the services and products you request, and related customer services (this includes providing the Mitchell Arts Centre website, website administration and security). We also analyse this information to improve our understanding of you and our customer base in general. We do this so that we can make better decisions about our services, advertising, products and content, based on a more informed picture of how our customers use our current services, and to provide you with a more customised experience. Depending on your marketing preferences, we may use this information to help us to determine which offers, information, discounts and promotions you would most like to receive.

1.5. Direct Marketing

When you first register with the Mitchell Arts Centre website, call us or visit our Box Office, you can decide whether your contact information may be used by us, our Partners and selected third parties for direct marketing purposes. Depending on your selection, Mitchell Arts Centre, its Partners and/or other third parties may contact you by e-mail or post with information or offers regarding their goods and services such as discounts, exclusive offers or special event information. Unless you opt-out, Mitchell Arts Centre will send you a monthly newsletter with information about upcoming shows and events. If you purchase a ticket for an event, your address will be entered into Mitchell Arts Centre ticketing database service. You will be given an opportunity to unsubscribe in every marketing e-mail we send you.

1.6. Partner Marketing
You may also receive marketing information from the Partners for the events for which you have purchased tickets. If you do not wish to receive marketing correspondence from a Partner please use the unsubscribe link in their communications or contact them directly to request that your details are removed from their databases.

1.7. Carefully selected third parties
If you've given your consent when registering for your personal information to be provided to carefully selected third parties (other than Mitchell Arts Centre’s Partners) they may contact you by post, telephone or email with information or offers regarding their goods and services.

 

1.8. Changing your marketing Preferences

If you change your mind or want to amend your marketing preferences, you can do so at any time from your online account, calling us or visiting Mitchell Arts Centre Box Office during our opening hours. Please note that you will always continue to receive customer service emails from Mitchell Arts Centre – and these could include order confirmations, event reminders, information about changes to an event you've purchased tickets for and reminders to print your tickets if you've selected that option for ticket delivery.

 

1.9. Information sharing and/or transfer

Mitchell Arts Centre and its Partners will not share your data with any third parties without your consent, except under the following circumstances:

  • If we use a third party supplier to carry out specific business operations (e.g. a courier) but only if we have in place a written agreement protecting your information
  • If you have purchased other goods or services via our website such as merchandise, in which case your information may be shared with third parties to process and fulfil your orders.
  • If you enter a competition, promotion or a prize draw by our Partners or third parties, and Mitchell Arts Centre is not the operator, the information you provide will be shared with the operator of the promotion, competition or prize draw
  • If we consider it necessary to comply with laws or regulations, to assist law enforcement, to protect the rights, property, or safety of Mitchell Arts Centre, our customers, users of this Site, or others.

 

1.10. How your financial information is collected and used

If you are purchasing tickets, you will be asked to provide financial information (your payment card information) each time you make a purchase. We use something called HCC (Hosted Card Capture) this means everything is captured by DataCash and the information is handled in a PCI Compliant way. Financial information we collect is used to authorise payment and bill you for your purchases through Mitchell Arts Centre website, phone sales or Box Office sales in person. When you make a purchase from Mitchell Arts Centre, your consent is given to provide your financial or personal information to those third parties necessary to process your transactions with us, such as credit card companies and banks. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction. Where we do share this data, we apply payment industry standard encryption methods to maintain its security. If you've ordered any additional goods or services through Mitchell Arts Centre such as merchandise, your information may be passed to the providers of such goods or services so they can process your transaction and provide you with the goods or services you have ordered. Except for processes explained above, we will not share your financial information with any third parties without your prior consent.

 

1.11. Changes to this privacy policy and your rights

We refer the right to make some changes and adjustments to this privacy policy from time to time, so please check regularly for any updates. Where there's a significant change to this privacy policy, we'll always notify you so that you can decide whether to continue using our services. You can edit and view the information about you that you've provided to us by logging on to your account on the website. You also have the right to obtain a copy of the personal data we hold about you to correct any inaccuracies in such data. If you wish to exercise any of these rights, please contact us using the details at the end of this document. For some requests we may ask you to provide: proof of identity, further information to enable us to locate the information you have requested, and/or a payment of £10 to cover our costs. Your request will be dealt with as soon as possible and will not take more than 30 days to process. Mitchell Arts Centre also has a complaints procedure and details can be requested by contacting us using the details at the end of this document.

2.TERMS & CONDITIONS FOR SALES

Our terms & conditions for sales are designed to ensure your satisfaction and understanding of the purchase process on Mitchell Arts Centre.

 

2.1 Tickets

 

i.Mitchell Arts Centre sells tickets for its own events, as well as other events on behalf of promoters, producers, teams, performers and venues. We refer to these parties who organise or provide the event and/or from whom we obtain tickets to sell to you as our "Partner".

  1. Tickets purchased from Mitchell Arts Centre may be subject to a per transaction booking fee and a per order handling charge. The current charges are:
    1. £1.50 booking fee (charge per transaction) for purchases online or over the phone
    2. There is no booking fee for tickets purchased in person from the Mitchell Arts Centre Box Office
    3. £1.00 handling fee for mailed tickets per ticket order, maximum 15 tickets per one charge.
    4. There are no handling fees for E-tickets printed by the clients themselves
  2. Tickets may be restricted to a maximum number per person, per credit card and, for some events; a restriction may apply per household. We reserve the right to cancel tickets purchased in excess of this number without prior notice.

iv.Unlawful resale (or attempted unlawful resale) of a ticket is grounds for seizure or cancellation of that ticket without refund or other compensation. A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written permission is given by Mitchell Arts Centre and/or their Partner, provided that even if such consent is obtained, use of Mitchell Arts Centre’s and/or its Partners trademarks and other intellectual property is subject to prior consent.

v.In order to prevent fraud and to protect both parties, you may be asked to provide additional information after your booking so that we can verify your purchase. We reserve the right to cancel any order that further to investigation we deem to be possibly of a fraudulent nature. These checks may include, but not be limited to, a request to be provided with an original credit or debit card statement, attempts to contact a customer by telephone, reference to records to check for other fraudulent activity at an address.

vi.Unless with the express written permission from us and/or our Partner, you may not combine a ticket with any hospitality, travel or accommodation service and/or any other merchandise, product or service to create a ticket package and sell or otherwise transfer (or facilitate the sale or transfer of) such ticket package for profit or commercial gain, offer such ticket package as an incentive or prize in a promotion or competition, or otherwise dispose of such ticket package in the course of a business.

vii.Mitchell Arts Centre aims to dispatch tickets as soon as possible. We are not able to specify the exact dates of dispatch and tickets will be dispatched Tuesday – Saturday only. Tickets are dispatched using Royal Mail First Class standard mail to the address provided by the client. It is the responsibility of the customer to inform Mitchell Arts Centre of any change of address, contact phone number or email address, both before and after receipt of the goods. Please allow as much time as possible for your tickets to arrive. Please note that in the last 7 days prior an event we are unable to post tickets but will continue selling for Venue Collects and E-tickets. If your tickets have not arrived seven days before the event, please contact us. If tickets that are dispatched are returned to Mitchell Arts Centre ticket agency as "addressee unknown", we reserve the right to cancel the order.

  1. We will not be responsible for any tickets that are lost or stolen.
  2. For information about a purchase you've made, you can contact us using the details at the end of this document.

x.It is your responsibility to your tickets; mistakes cannot always be rectified. Tickets are valid for the date shown on the date to which the event is transferred in the occurrence of a rescheduling, it is the responsibility of the ticket holder to ascertain the date and start time of any rearranged event.

xi.Duplication of tickets is not permitted.

xii.Tickets cannot be money refunded, except under the following circumstances:

  1. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of tickets you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price (and credit or debit your account as applicable) or cancelling your order. If we are unable to contact you, you agree that we may treat the order as cancelled. If you choose to cancel after you have already paid the incorrect ticket price for the tickets, you will receive a full refund from us.
  2. Occasionally, events are cancelled or postponed by Mitchell Arts Centre, performer or our Partner for a variety of reasons. Contact us for exact instructions using the details at the end of this document. Unless indicated otherwise in relation to a particular event, if an event is cancelled, ticket holders will be offered seats at any rescheduled event (subject to availability) up to the face value of the tickets or, if the ticket holder is unable to attend the rescheduled event or the event is not rescheduled, a refund. Refunds for tickets purchased prior to the date of the original event will be given up to their face value plus the relevant per ticket booking fee. If an event (e.g. a festival) takes place over several days and only one day is cancelled, a partial refund only may be payable corresponding to the day(s) cancelled. If the event is moved or rescheduled, Mitchell Arts Centre or its Partner may set refund limitations. In order to claim your refund, please apply in writing to your point of purchase. You must enclose your unused tickets and comply with any other reasonable instructions of Mitchell Arts Centre. Your unused tickets must be received within 28 days from the date of the cancelled event. Mitchell Arts Centre or its Partners will not be responsible for any tickets that are lost or stolen, please use recorded mail where necessary. This does not affect your statutory rights. Refunds will be paid either into the customer’s account of they paid by card or by cheque.
  1. It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify ticket holders of the cancellation once we are aware of any changes or have received the relevant authorisation from our Partner. We do not guarantee that ticket holders will be informed of such cancellation before the date of the event.
  2. Tickets are sold subject to Mitchell Arts Centre’s or its Partner's rights to alter or vary the programme and their cast/line up due to events or circumstances beyond their reasonable control without being obliged to refund monies or exchange tickets.
  3. Mitchell Arts Centre reserves the right to refuse admission should patrons breach any terms and conditions of the event or Partner. Mitchell Arts Centre may on occasions have to conduct security searches to ensure the safety of the patrons. Mitchell Arts Centre ticket agency would advise customers that no refunds will be offered to customers who are refused entry or ejected from a venue on account of late arrival, being (or appearing to be) under age, declining to be searched, abusive, threatening, drunken or other antisocial behaviour (including smoking in no smoking areas), carrying offensive weapons or illegal substances, or making unauthorised audio, video or photographic recordings. Events and ticket types where an age restriction applies are clearly indicated during the booking process. Please ensure that you read all the information that applies to the event/ticket you are booking, and carry proof of age if appropriate. Under 16s must be accompanied by a responsible adult aged 18 or over.
  4. Every effort to admit latecomers will be made at a suitable break in the event, but admission cannot always be guaranteed and admitting latecomers may be prohibited by our Partners.
  5. The ticket holder has a right only to a seat of a value corresponding to that stated on the ticket and Mitchell Arts Centre or our Partner reserves the right to provide alternative seats to those specified on the tickets.
  6. There will be no pass-outs or re-admissions of any kind.
  7. The unauthorised use of photographic and recording equipment is prohibited. Tapes or films may be destroyed. Laser pens, mobile phones, dogs (except guide dogs) and patron's own food and drink, glass and electrical cigarettes are also prohibited. Mitchell Arts Centre operates a non-smoking policy, smoking is only allowed outside on the designated areas.
  8. Ticket holders consent to filming and sound recording as members of the audience. The Mitchell Arts Centre or its Partners may carry out general photography, audio and/or audio visual recordings in or about the venue. By purchasing tickets you consent to you and your party being included in and to the exploitation of such photography or recordings without any payment to you or to your party.
  9. Mitchell Arts Centre and/or its Partners accept no responsibility for any personal property.
  10. Unless paragraph 2.1./xii. applies, neither Mitchell Arts Centre nor its Partners shall have any further liability beyond the face value of the ticket purchased plus the relevant per ticket service charge. Neither or them shall be liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the Event which have been arranged by you are at your own risk.
  11. For issues regarding tickets purchased directly from the Partners of Mitchell Arts Centre, please contact the Partners directly as Mitchell Arts Centre does not take any responsibility for tickets purchased from Partners or other outlets.
  12. Nothing in these terms and conditions seeks to exclude any liability of Mitchell Arts Centre or its Partners for death or personal injury caused by its/their negligence, fraud or other type of liability which cannot by law be excluded or limited.
  13. If you are unhappy about the service you have received, Mitchell Arts Centre has a complaints policy and details can be requested by contacting us using the details at the end of this document.
  14. All of these terms and conditions are governed by English Law and any disputes arising out of any transaction with Mitchell Arts Centre are subject to the exclusive jurisdiction of the English Courts.

 

 

2.2. Merchandise and other sales

 

i.If you are 16 years old or younger you may not purchase goods/services from us. Please ask a parent or guardian to do so on your behalf.

ii.You may not use the Mitchell Arts Centre merchandise website in any improper or unlawful manner or in breach of any legislation or licence that applies to you.

iii.From time to time it maypossible to enter competitions or prize draws through the Merchandise Site. There may be additional terms and conditions applicable to those competitions or prize draws. Where additional terms apply you will be notified of that fact and given an opportunity to read those terms and conditions before you enter the competition or the prize draw.

iv.All Intellectual Property Rights in or to the materials and information made available to you through the Mitchell Arts Centre merchandise website including but not limited to our registered and unregistered trademarks either owned by us or licensed to us by our third party partners. You may only use such information or materials in accordance with these Terms of Use. Except as expressly provided in these Terms of Use, we do not grant any express or implied right to you to use the materials or information made available to you through the Mitchell Arts Centre merchandise website and nothing in these terms of use and sales shall be construed as an assignment of any Intellectual Property Rights in or to such materials or information. All our rights are hereby expressly reserved.

v.We do not give you any rights in relation to Intellectual Property Rights in any product or service that you purchase from or via the Mitchell Arts Centre website, phone sales or Box Office Shop.

vi.All prices for goods and services that we sell to you on or via the Mitchell Arts Centre website, phone sales or Box Office Shop include (where relevant) VAT in the UK and are quoted in pounds sterling.

vii.If you order goods for postal delivery from us we use a delivery partner to deliver such goods to you and we aim to deliver them to you according to our prevailing delivery period where we have the relevant item in stock. Should we not hold the item ordered by you in stock, we will notify you at the email address which you gave us as part of the registration information.

viii.Please order from us in enough time to present any loss or disappointment resulting from any delay in the delivery time.

ix.Each order placed with us is separate and is treated as an individual order although each will be governed by these Terms of Use.

x.We will not take any responsibility for goods once they have been passed on to Royal Mail or other courier. Risk in the goods passes to you upon delivery.

xi.We do not deliver outside the UK.

xii.When you place an order for products on the Merchandise Site you are making us an offer to buy such products for the price stated, subject to these Terms of Use. If the products are third party products, we are not party to the contract.

xiii.We will confirm all orders via email, using the email account that you give us as part of the registration information. In the event that the product or service you order is out of stock or otherwise unavailable, we will inform you of that fact together, where we are so aware, of the time at which the product or service will become available. If the product or service is available and the details of your order are clear to us, our email to you will be deemed an acknowledgement of your offer and it will specify delivery details and confirm the price of the goods or service purchased. Payments can only be made using the options specified by Mitchell Arts Centre at the time of the purchase and processing and handling fees will apply as per our valid price list. These fees will be added to your final bill at the time of the check out and payment.

xiv.We cannot guarantee that particular goods and services will always be available. If we cannot supply the requested product you will not be charged for it and we will refund or re-credit your account with any amount that we may have debited.

xv.We may cancel any sale and not supply products or services if it is reasonable to do so and may change or discontinue the availability of any product at any time at our sole discretion. However, if we do so, we will always notify you that we shall do so and, where relevant, refund you all payments made by you.

xvi.Your credit card company may perform an additional security check to confirm that the cardholder is making the purchase. We are not responsible in respect of any such security check.

  1. A dispatch note will be sent to the credit or debit card billing address and not the shipping or delivery address (if different). Please ensure that your goods are being delivered to the required address. You are responsible for ensuring that the goods reach the intended address.
  2. We aim to ensure that goods ordered from us are packaged securely so that they arrive with you undamaged. However, if goods arrive which have been damaged or have defects, we will either replace such goods free of charge or alternatively give you a full refund if you return the product to us. Refunds are subject to proof from courier of damaged goods being identified at the time of the delivery. Any item dispatched to you will indicate this returns address. Although we are confident of the high quality of our goods, we recognise that there may be occasions when a customer might wish to return an item. You may return a purchase to us in its original condition and packaging within 30 days for a refund or replacement, where possible. Please enclose a note giving your name, address, contact telephone number and e-mail address, together with the reason for the return. We will ask you to keep proof of posting the goods to us. Postage will only be refunded if the item is faulty or incorrectly supplied from the original order. We recommend that you use a recorded delivery when returning goods. This returns policy does not affect your statutory rights.

xix.Please note that we cannot give refunds in respect of personalised goods or goods which by their nature cannot be returned to us, goods which deteriorate or expire rapidly, or which are by their nature time-sensitive, or in relation to any video cassette, CD, DVD, or other digital medium the seal of which has been broken. Therefore, when purchasing such items, please think carefully before you buy.

xx.There is no warranty on any of the merchandise goods or services purchased from Mitchell Arts Centre, goods are sold ‘as is’ basis. This will not affect your statutory rights.

  1. Nothing in these terms and conditions seeks to exclude any liability of Mitchell Arts Centre or its Partners for death or personal injury caused by its/their negligence, fraud or other type of liability which cannot by law be excluded or limited.
